    Cyber crime law? What are this law talks about? It is good for the Filipino citizen or it is a resulting of disturbance for the internet user. How about the freedom can the people free to shows, tells and shares their different ideas and opinion on the happenings surrounding us and the daily activities that we were encountered. Who are people behind this law and what are the purposes of implementing this kind of law that shocking the majority of the internet user and can be the cyber crime law affects the electronic commerce security especially to the individuals and business.

 

 Republic Act No. 10175  

AN ACT DEFINING CYBERCRIME, PROVIDING FOR THE PREVENTION, INVESTIGATION, SUPPRESSION, AND THE IMPOSITION OF PENALTIES THEREFOR AND FOR OTHER PURPOSES

 

Republic Act (RA 10175) was approved by PNOY last September 12, 2012. It is an act defining cyber crime, providing for prevention, investigation, suppression and the imposition of penalties therefor and for other purposes.

The National Bureau of Investigation (NBI) and the Philippine National Police (PNP) shall be responsible for efficient and effective law enforcement of the provisions of this Act. The NBI and PNP shall organize a cyber crime unit or centre manned by special investigators to exclusively handle cases involving violations of this Act.

One would question out the internet activities may include in the RA 10175 or Philippines Republic Act on Anti-Cybercrime Law and some of these are; Computer-related fraud, Cybersex, Illegal access to a computer system, Cyber squatting, Illegal interception of data, Computer-related identity theft, damaging of data, System interference, altering computer data, the use of viruses and the use, production, sale, or making available without right of malware, passwords , and authority, and pornography. Is these all part and covered by the Anti Cyber Crime Law?

Benefits and Advantages of RA 10175   

1.Business on the internet are protected with this law.
2. Cyber Sex and Cyber Bullying is now a crime and punishable.
3. Tech knowledge for government will be lift up to combat cyber crimes such as hacking and theft.

Prohibited

Computer-related offenses such as computer-related forgery, fraud and identity theft over the Internet are also covered by the new law.

Under the new law, unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, are those “committed through a computer system or any other similar means which may be devised in the future.”

The law directs the National Bureau of Investigation (NBI) and the PNP to create a cybercrime unit or a center manned by special investigators.

NBI 7 Assistant Regional Director Lauro Reyes said their headquarters in Manila houses the Anti-fraud and Computer Crimes Division (AFCCD). But since the AFCCD does not have a regional unit, NBI 7 refers Internet-related cases to its central office, he added.

The CPPO, though, has a forensic laboratory in Barangay Lahug, Cebu City. The laboratory can track down cyber crimes like online pornography.

The police cracked down on home-based cyberpornography operations in Cebu that victimizes children. Two cases of child cyberporn were reported in Cordova last year.

AN ACT PROTECTING INDIVIDUAL PERSONAL INFORMATION IN INFORMATION AND COMMUNICATIONS SYSTEMS IN THE GOVERNMENT AND THE PRIVATE SECTOR, CREATING FOR THIS PURPOSE A NATIONAL PRIVACY COMMISSION, AND FOR OTHER PURPOSES

Advantages and Disadvantages    

  1. Commission shall refer to the National Privacy Commission created by virtue of this Act.
  2.  Consent of the data subject refers to any freely given, specific, informed indication of will, whereby the data subject agrees to the collection and processing of personal information about and/or relating to him or her. Consent shall be evidenced by written, electronic or recorded means. It may also be given on behalf of the data subject by an agent specifically authorized by the data subject to do so.
  3. Data subject refers to an individual whose personal information is processed.
  4. Direct marketing refers to communication by whatever means of any advertising or marketing material which is directed to particular individuals.
  5. Filing system refers to any act of information relating to natural or juridical persons to the extent that, although the information is not processed by equipment operating automatically in response to instructions given for that purpose, the set is structured, either by reference to individuals or by reference to criteria relating to individuals, in such a way that specific information relating to a particular person is readily accessible.
  6. Information and Communications System refers to a system for generating, sending, receiving, storing or otherwise processing electronic data messages or electronic documents and includes the computer system or other similar device by or which data is recorded, transmitted or stored and any procedure related to the recording, transmission or storage of electronic data, electronic message, or electronic document.
  7. Personal information refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.
  8. Personal information controller refers to a person or organization who controls the collection, holding, processing or use of personal information, including a person or organization who instructs another person or organization to collect, hold, process, use, transfer or disclose personal information on his or her behalf.

 

     Freedom is the only thing that the people wanted to have, If our intention is good that is enough but if we think that the opinions and the actions that we doing is bad we need to think the consequences for that and we as a people  of this society we should have a knowledge and ideas on the things happened around us.
